Terms of Use
These terms explain the role of Atoll Maker, the limits of the service and the responsibilities that remain with each project owner, builder and appointed professional.
1. The service
Atoll Maker provides design software, educational content, generated calculations, guidance, schedules, quantities, drawings and other project information based on data entered by the user. Outputs are intended to support planning, communication and informed decision making.
2. No professional appointment
Use or purchase of Atoll Maker does not appoint Atoll Maker, Karoly M. or any associated person as architect, engineer, lead designer, contract administrator, principal designer, principal contractor, contractor, construction manager or construction supervisor.
No architect client, engineer client, consultant client, contractor client or other professional relationship is created by access to the platform, purchase of a plan, use of generated documents, participation in a review, or communication through the service. Any professional consultancy service must be set out in a separate written agreement signed by the relevant parties.
3. User and project owner responsibilities
The user and project owner remain responsible for:
- providing complete and accurate project information;
- checking dimensions, levels, boundaries, access, ownership and site constraints;
- obtaining surveys, investigations, consents, permissions and statutory approvals;
- appointing competent builders, contractors and professional advisers where required;
- confirming that the design and proposed works are suitable for the actual site;
- ensuring compliance with planning, building, environmental, health and safety and other local requirements.
4. Builder and contractor responsibilities
Construction drawings, schedules, quantities, shopping lists and guidance are provided to assist the construction process. They do not replace the contractor's professional judgement, site inspection, setting out, temporary works, method statements, risk assessments, coordination or duty to carry out the work competently.
The appointed builder or contractor must verify dimensions, levels, materials, ground conditions, utilities, access, structural requirements, installation details and compliance before and during construction. Workmanship, sequencing, procurement and site safety remain the responsibility of the appointed contractor and project owner.
5. Site conditions and third party information
Atoll Maker cannot inspect the site or independently verify soil, groundwater, contamination, drainage, utilities, trees, ecology, structures, boundaries, weather exposure or other physical conditions. Generated outputs rely on information supplied by the user and may not account for unknown or changing site conditions.
Maps, aerial images, product information, prices and other third party data may be incomplete, approximate or change over time. They must be checked before reliance or purchase.
6. Calculations and generated outputs
Calculations, recommendations and documents are generated from the information entered and the rules available within the platform. They are tools for design development and communication, not a guarantee of performance, approval, cost, programme, water quality or construction outcome.
Any output that affects structural safety, electrical safety, public safety, statutory compliance or specialist engineering must be reviewed by an appropriately qualified person where required by the project, location or law.
7. Reviews and support
A review, support response or discussion provided through Atoll Maker is limited to the stated scope of that service. It does not amount to site supervision, certification of construction, contract administration, inspection of workmanship or acceptance of responsibility for the complete project.
8. Genesis Ecossistemas reference
References to Genesis Ecossistemas describe the founder's training and professional background only. Unless expressly confirmed in writing, Genesis Ecossistemas has not endorsed, certified, approved or assumed responsibility for Atoll Maker, its content, its calculations or projects created with the platform.
9. Products and off the shelf components
Instructions may describe systems assembled from readily available components. Users and contractors are responsible for confirming compatibility, ratings, installation requirements, warranties, safe operation and suitability. Products may be purchased from independent suppliers, and Atoll Maker is not responsible for third party products or supplier performance.
10. Liability
To the fullest extent permitted by law, Atoll Maker is not responsible for losses arising from inaccurate user inputs, undisclosed site conditions, statutory decisions, contractor performance, workmanship, procurement, product failure, unauthorised alterations, misuse of outputs or failure to obtain appropriate professional advice.
Nothing in these terms excludes or limits liability where it cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence.
11. Consumer rights
These terms do not remove rights that consumers have under applicable law. Refunds, cancellations and access terms for paid products will be described at checkout and in the applicable purchase terms.
12. Plans, renewals and upgrades
Free is the free access tier. Hobby is the paid personal and non-commercial tier. Pro is the commercial tier for professional client work. Features, limits and prices for each plan are those shown at checkout at the time of purchase.
Where a plan renews automatically, the renewal price, billing interval and cancellation method will be shown before purchase. Cancelling future renewal does not remove access already paid for during the current billing period. Generated files already exported by the user remain available to the user, subject to these terms and any third party rights.
Where Atoll Maker offers an upgrade credit, the applicable credit and resulting price will be shown at upgrade checkout. Promotional or founding upgrade rules may change for future purchases, but changes will not retrospectively reduce a credit already expressly promised for an existing purchase.
13. Intellectual property and permitted use
The software, method, educational content, templates and platform materials remain the intellectual property of Atoll Maker or the relevant rights holder. A purchased licence permits use within the scope of the selected plan. Hobby is for personal, non-commercial use by the purchaser. Pro is required for paid client work, commercial design or construction services for third parties unless otherwise agreed in writing.
14. Changes to the service and terms
The platform and these terms may be updated as the service develops. The version presented at the time of purchase or use will apply as required by law.
15. Governing law
These terms are intended to be governed by the laws of England and Wales, with disputes subject to the courts of England and Wales, except where mandatory consumer law requires otherwise.
16. Usage analytics and session recording
Visits to the pages of atollmaker.com are counted: the page viewed, the time spent on it, the page that linked to it, the browser and type of device, and the connection's network address, from which the country is derived. Nothing is stored on the visitor's device to do so — no cookie and no local or session storage — so a visit is not linked to any other visit or to an account. The email address given to register for the beta is not part of these records.
While a user is signed in, Atoll Maker records how the application is used in order to find faults and improve the service. In the application, nothing is recorded while a user is signed out. Both kinds of record are processed by PostHog, Inc. and held in its European Union region.
Three kinds of record are kept. First, the actions completed in the application — for example a project created, a drawing set generated or an export completed — with counts and size ranges, never the design itself. Second, errors the application meets, with the browser, operating system and graphics device in use. Third, a recording of the application's interface during the session. Text typed into any field is masked; the 3D view, the drawing sheets, the works booklet and the project's own details — its name, the client, the address and the practice details — are not recorded.
An account is identified by its internal identifier; the email address and password are not sent. Beta testers may be identified by the name on their invitation. The records are used only by Atoll Maker to operate and improve the service; they are not sold and not used for advertising. A user may ask for their records to be deleted through the report key in the application.
17. Legal review
This draft should be reviewed by a solicitor before launch, particularly the liability cap, refund terms, consumer cancellation rights, governing law, business identity and contact details.
